Confirmed: International Criminal Court biased against Israel

There is a reason many nations, including the United States and Israel, refused to join the International Criminal Court (ICC).

The fear was that ICC, created by the 1998 Rome Treaty, would go the way of entities like the UN Human Rights Council, and turn into a political operation directed at the West, the U.S. military, and Israel in particular.

The ICC just proved that these fears were warranted, with an outrageous decision overruling an ICC prosecutor’s decision not to investigate the Maarvi Mari incident, and requiring reconsideration because of international political concerns.

In the Mavi Marmara incident, covered here many times (see Featured Image), Israeli commandos boarded a ship part of the 2010 Gaza flotilla organized by Turkish Islamists. The Israeli troops were attacked and responded with gunfire which killed 9 Turkish citizens.

The incident caused a political rift between Israel and the already anti-Israel, anti-Semitic Islamist Turkish Prime Minister Recep Tayyip Erdogan.

A UN panel determined that Israel’s naval blockade of Hamas-run Gaza complied with international law, and that Israel faced “organized and violent resistance” when it legally boarded the Mavi Marmara.

The ICC prosecutor decided not to open a formal investigation (.pdf) of the Mavi Marmara incident as a war crime, given the limited scope of the incident.

The ICC judges just ordered otherwise, requiring reconsideration as reports Law Professor Avi Bell in The Times of Israel, The ICC declares war on Israel:

The Pre-Trial Chamber of the International Criminal Court, for the first time in its history, has ordered the ICC Prosecutor to pursue an investigation she has decided to close. The Chamber ruled that the Prosecutor was wrong to close the preliminary investigation into war crimes charges against Israel for crimes allegedly committed in boarding the Mavi Marmara and other vessels during the flotilla incident of 2010.

The ruling of the Pre-Trial Chamber is remarkable.

It holds that the Prosecutor should have taken into account facts and actions that are outside the jurisdiction of the court in deciding whether to bring charges.

It holds that the Prosecutor should assume the truth of even the wildest accusations in deciding whether to bring charges; in other words, there should be an irrebuttable presumption of guilt in the preliminary investigation stage.

And most shockingly, it holds that crimes have sufficient gravity to interest the court, even if they have very few actual victims, as long as they are widely covered by the media, and are subject to a lot of political activity at the UN.

The key to the outrage was that the ICC demanded that international political considerations be taken into account by the prosecutor, something that normally would be outside the consideration of a prosecutor, and a consideration that taints any ruling directed at Israel. The ICC compounded that error by specifically requiring consideration of the views of the anti-Israel UN Human Rights Council.

Here is the key paragraph (.pdf)(emphasis added):

48. In any case, the Chamber is of the view that, in light of the available information, the Prosecutor should have recognised the possibility that the events at issue had an impact going beyond the suffering of the direct and indirect victims. Indeed, as submitted by the Comoros, the commission of the identified crimes on the Mavi Marmara, which were highly publicised, would have sent a clear and strong message to the people in Gaza (and beyond) that the blockade of Gaza was in full force and that even the delivery of humanitarian aid would be controlled and supervised by the Israeli authorities. Also, the international concern caused by the events at issue, which, inter alia, resulted in several fact-finding missions, including by the UN Human Rights Council and the UN Secretary General, is somehow at odds with the Prosecutor's simplistic conclusion that the impact of the identified crimes po ints towards the insufficient gravity of the potential ICC-01/13-34 16-07-2015 24/27 EC PT No. ICC-01/13 25/27 16 July 2015 case(s) on the mere grounds that the supplies carried by the vessels in the flotilla were ultimately later distributed to the population in Gaza.

In other words, the ICC turned a prosecutorial consideration into a political decision, by deferring to UN bodies and public opinion that are hopelessly biased against Israel.

As Law Professor Eugene Kontorovich points out, the ICC judges made it clear that Israel has no chance of a fair hearing at the ICC:

Law Professor Kevin Jon Heller has a scathing critique of the decision, The [ICC] Pre-Trial Chamber's Dangerous Comoros Review Decision:

To put it simply, this is a deeply problematic and extremely dangerous decision — nothing less than a frontal assault on the OTP's prosecutorial discretion, despite the PTC's claims to the contrary. I will explain why in this (very long) post.

Bias against Israel is not manifested merely by rulings against Israel, but by applying different standards and scrutiny to Israeli conduct. The ICC just exhibited clear bias.

If only the Mavi Marmara incident were involved, it would be bad enough.

But this may be an indication that in ruling on Palestinian Authority requests for an investigation of Israel the ICC will require prosecutors to take into account international political considerations.

When the Palestinians decided to join the ICC, numerous international law experts predicted that under established precedent, the investigation should not even formally proceed. I was skeptical:

Sure enough, already we have seen the ICC treat Israel differently with regard to the Palestinian charges, Int'l Criminal Court already treating Israel differently (quoting Prof. Kontorovich):

The ICC's Prosecutor announced today the opening of a "preliminary examination" into "the Situation in Palestine." This means she will consider, on jurisdictional, evidentiary and policy grounds whether to open an investigation into crimes that may have been committed during this summer's Gaza conflict. Opening such an investigation is a fairly standard step after receiving a declaration of acceptance of jurisdiction under Article 12(3) of the Rome Statute, and would not normally warrant much notice (other preliminary investigations also involve alleged crimes by the U.S. in Afghanistan and the U.K. in Iraq, though precious few Americans or British are aware of this).

But this decision of the prosecutor is quite different, and extremely significant. The decision to open the inquiry involved the prosecutor determining that the Palestinian Authority is in fact a "state," a necessary precondition to jurisdiction under the Rome Statute, the Court's constitutive treaty.

The ICC has never accepted jurisdiction over what is clearly at most a "marginal" state – one that is not a U.N. member, that has not ever claimed to govern any territory, and whose recognition by other states is limited (for example, the U.S., Canada and most Western European states do not recognize the existence of a Palestinian state). This is clearly dramatically different from anything the Court has done before.

The Mavi Marmara ruling together with ICC procedural rulings on the Palestinian charges portends another international anti-Israel kangaroo court.

The ultimate damage will be to the credibility of the ICC.

Obama on the Chattanooga killing of 4 Marines: A heartbreaking circumstance

In Chattanooga, four U.S. Marines were gunned down in a jihad attack by an Islamic man who didn’t properly observe the “gun free zone” sign.

This quote from Obama is something else:

“A heartbreaking circumstance” sounds like a Lifetime movie, but not how to describe the murder of four Marines.

Well, the White House couldn’t go into too much detail or risk looking a little silly, having tweeted this an hour earlier:

It’s amazing how fast the WH spin machine can go about either assigning blame or ignoring it depending on how a situation fits their political goals.

To paraphrase Mark Levin, our soldiers aren’t trusted with guns at military facilities but the Obama administration trusts Iran with nukes. This is the world we now live in.

You can add Lt Col. Ralph Peters to the host of experts who are appalled by Obama’s nuclear deal with Iran.

“This is all such a sad thing,” Peters told Fox News Host Kennedy. “They whipped Obama and Kerry. They conned them totally. And so what they got was basically – if you like your nuclear program, you can keep your nuclear program. Just don’t pop a nuke for eighteen months until Obama is out of power.”

Peters went on to say that Iran is “well on their way with their dream of recreating their 2,500 year old Persian empire.”

Kennedy asked Peters what the next president would do with Obama’s Iranian nuke deal.

Peters answered, “the real question is what will the next presidents do – because Obama has done so much damage in foreign policy, it will take successive administrations to fix it – if it can be fixed.”

He added that the first thing the next president will have to do is, “get serious about supporting Israel and our clients and stop sucking up to enemies like Iran and Vladimir Putin. Our enemies will never love us. Our allies are now afraid of us.”

As I said early on in Obama’s presidency – I felt like we were becoming part of the “Axis of Evil.” With this nuclear deal – it appears we have.

‘This Agreement Will Have Bloody And Brutal Consequences.’ – @MarkSteynOnline

Mark Steyn is onto something here [emphasis mine]:

I checked in with Sean Hannity on Fox News to share my thoughts on both the Iran “deal” and illegal immigration. You can see the full interview here.

Sean started by cross-cutting Barack Obama on Tuesday with Neville Chamberlain in 1938. But I thought that comparison was unfair to Chamberlain. He was an honorable man who loved his country and just happened to get the greatest issue of the day wrong. You can’t say the same of Obama:

Steyn said he thinks what President Barack Obama did is “significantly worse” than what former British prime minister Neville Chamberlain did. He also stated that he doesn’t think the president was negotiating on behalf of the United States.

“I think what happened at these talks is that he and the Iranians were in a sense negotiating together to anoint Iran as the regional power in the Middle East and to facilitate Iran’s re-entry, the biggest planetary sponsor of terrorism, to facilitate its re-entry into the global community,” Steyn said. “That’s what Obama was there doing.”

I think the nuclear issue was a mere pretext, a Hitchcockian McGuffin. Iran will be a nuclear state, and very soon. The joke inspections regime – under which Teheran can block any inspections for the best part of a month – will facilitate the nuclearization of Iran and prevent anyone who objects to it – such as Israel – from doing anything about it. That’s a given.

But that’s not what the talks were about. Obama’s vision of the post-American Middle East sees Iran as the dominant power, and that’s what the negotiations were there to finesse. As I said to Sean, Obama’s belief that American power and influence has been bad for the world extends beyond America itself to America’s allies. So on missile defense he takes the side of Russia over US allies like Poland and the Czech Republic; in the Falklands he takes the side of Argentina over the United Kingdom; and now in the Middle East he takes the side of Iran over the Sunni Arab monarchies and Israel.

This agreement will have bloody and brutal consequences.

Dead [literally and figuratively] solid perfect.

-I think we can now state with much certainty now that ‘Obama’ is full of Shia.

-We’ve all been trying to figure out why ‘Barack Hussein Obama’ has been acting as he has in the Middle East and I think Mark has hit upon the exact answer.

This is not about the rank stupidity and ignorance of The Jarrett Junto.

These fools believe that they can readjust the Balances Of Power in the World so that the the various ‘Enlightened Regimes’ [ie: ‘Totalitarian Hellholes’] can each be allotted their own regions where they can be the dominant power [kind of like when Lucky Luciano split New York into The Five Families]. This will allow, so the thinking of the Left In America goes in it’s funhouse mirror view of Power Politics, The Jarrett Junto to concentrate on the ‘important’ task of bringing about Heaven On Earth in America.

The trouble is: the Totalitarians who are working closely with the Administration have no intention of being restricted to their territories – this, by the way, is where the rank stupidity and ignorance of The Jarrett Junto comes in. Some, like Fascist Russia and Red China, want to be the Sole Superpower, while the Muslims want to conquer the whole World.

Just as, domestically, the GOP Establishment are the Useful Idiots of the Democratic Party, so The Jarrett Junto are the Useful Idiots of Islam and the other Totalitarian Regimes of the World.

In their arrogant and total Ignorance, The Jarrett Junto is setting the stage for the deaths and/or Enslavement of millions of free people in America and the Anglosphere.

‘Death to America’ and ‘Goddamn America’, indeed.

Las Vegas Metro Officer Survives Point-Blank Murder Attempt When Suspect’s Gun Misfires

James Toroda was already fuming about an earlier incident with his estranged wife when Officer Carlos Luna pulled him over for a busted taillight.

Luna—who was wearing the body camera which captured the footage above—attempted to calm Toroda down. Sensing that Toroda was instead becoming even more agitated, Luna ordered Toroda out of his vehicle, and that’s when Toroda attempted to murder him.

He reached toward the passenger seat and pulled out a 9mm pistol hidden under a jacket. Luna tried to pull Todora away and out of the vehicle, and the two struggled briefly.

Todora then aimed the pistol at Luna's head and pulled the trigger, McMahill said.

The gun was loaded, McMahill said, but did not have a round in the chamber, so it did not fire but readied a round.

Luna heard the click and immediately pulled back and fell to the road, McMahill said. As he did, Todora pulled the trigger a second time.

This time, the gun fired, and a bullet went through a Jeep door frame and shattered the rear driver-side window.

Officer Kroening, who had approached the passenger-side door, saw the commotion and heard the gunshot, and fired three rounds at Todora, killing him.

There’s something slightly off about the Review-Journal story, as 9mm pistols don’t self-load from an empty chamber. Either Toroda cycled the slide to chamber a round after hearing a “click” instead of a “bang” before firing the second shot, or there was a round already chambered with a hard primer.

Either way, Officer Luna is incredibly lucky, and I suspect that he’s managed to thank both Officer Kroening and God for his still being alive.

Metro police will review the incident to ensure that all policies and procedures were followed, but admits that even the best training cannot prepare officers for every eventuality.

Houston Store Clerk Kills Two Of Three Armed Robbers

A family-owned convenience store was the target of a trio of armed robbers Monday in Houston for the second time in two weeks.

The violent thugs stormed into the store and began pistol-whipping the men behind the counter. They didn’t apparently see the clerk on the floor, who drew his concealed weapon and started dispensing instant justice.

Police are investigating after a convenience store clerk shot two suspects during an attempted robbery in southwest Houston.

According to the Houston Police Department, as the getaway driver waited outside, three masked men stormed the Super K store off Beechnut and pistol-whipped a clerk. The owner’s brother was on dinner break near the cooler and saw the robbery unfold, so he grabbed his gun and opened fire, striking two suspects.

“Another guy, holding the door, hold a gun to me so I shoot them,” said Dien Tu, the man who fired his gun.

The incident was recorded on surveillance video.

All four suspects took off, but the two injured ones were dropped off outside an apartment complex in the 7500 block of Beechnut. They were taken to Memorial Hermann Southwest Hospital. Police say they don’t believe they survived.

The owner says his store was robbed July 1 so he and his brother were prepared with guns to fight back. The clerk in that robbery was beaten so badly, he hasn’t been able to return to work.

Note well that this was not the first robbery that the family-owned business has survived.

Robbers with a similar modus operandi attacked the store on July 1 and beat the clerk on duty so bad that he still hasn’t been able to return to work. At that time, the store’s staff was unarmed.

They learned from their mistake.

They were better prepared this time, and instead of being victims, they were armed to deal with the threat… with finality.

I’m not a gambling man, but if I was, I’d be willing to wager that the surviving members of this gang of armed robbers won’t be coming back again anytime soon.

Hannibal Lecter ain’t got nothing on the profit-maximizing abortion ghoul caught on tape hawking aborted baby parts as she swilled wine and nibbled on a gourmet salad.

In newly released undercover footage from the pro-life Center for Medical Progress, seasoned abortionist Dr. Deborah Nucatola, who serves as national senior director of “medical services” at Planned Parenthood, chitter-chattered eagerly about fulfilling the bloodthirsty demand for “intact hearts,” “lower extremities” and lungs.

Price tag? “You know, I would throw a number out,” she babbled breezily as she twirled her fork. “I would say it’s probably anywhere from $ 30 to $ 100″ per specimen.

Hollywood couldn’t conjure monsters this chillingly, banally evil.

Nucatola exulted at how fetal livers have become tres chic: “A LOT of people” want them.

She then spoke of the new hot trends in body-parts trafficking as if she were raving about the latest craze for crop tops or artisanal cheese.

“I was like wow,” she gushed to her potential clients about the market for unborn baby hearts, “I didn’t even know!”

Like wow.

This master of murderous euphemism repeatedly referred to an unborn baby’s head as a “calvarium” and casually described the tricks and techniques she and her fellow abortionists use to “increase your chance of success.” Rotating the babies so they are delivered breech before being mutilated and slaughtered by the practitioners of Planned Butcherhood works fabulously, in case you were wondering.

Pausing only to swig more luxury libations from her jumbo wine glass, the loquacious death doc explained to investigators posing as fetal tissue company executives how her “providers” use “ultrasound guidance” to target the coveted body parts — “so they’ll know where they’re putting their forceps.”

In a singsong recitation, this lettuce-chomping Mengele in a silk tank top detailed how the “providers” use ultrasound to become “cognizant of where you put your graspers.”

This method is not employed to reduce the pain and suffering of unborn baby and mother, mind you. It’s to get “good at getting heart, lung, liver, because we know that — so I’m not gonna crush that part. I’m going to basically crush below, I’m gonna crush above, and I’m gonna see if I can get it all intact.”

Think about that. Planned Parenthood has officially declared it “torture” for women to see their unborn children through ultrasound before submitting to abortion. The billion-dollar abortion industry has lobbied vociferously against increasing ultrasound access to pregnant women on the fence about abortion.

But when the same imaging technology is used to help Planned Butcherhood’s “providers” place their forceps strategically to protect their precious organ commodities, it’s invaluable “guidance.”

Now you know if you didn’t already or if you were in abject denial. Planned Parenthood’s fetish for late-term abortion stems not from compassion for mothers, but from the cold-blooded drive to drum up cold, hard cash. The practice has continued for at least 15 years, when Planned Parenthood’s human harvesters in Kansas were first uncovered.

Can it get any more stomach-turning? Brace yourselves. This video is just the first in a series by the Center for Medical Progress, which has been investigating Planned Butcherhood’s illegal, immoral trafficking of aborted fetal parts for almost three years.

The expose comes after years of undercover journalistic work by Lila Grace Rose and Live Action, who have caught government-supported Planned Parenthood officials covering up for sexual predators, promoting gendercide, flouting health regulations and disclosure laws, soliciting money from racist eugenics zealots who want more black babies aborted, and perpetuating a homicidal racket in the name of “reproductive health.”

Nucatola is no rogue underling. She’s Planned Parenthood’s “senior director” of “medical services” with years of scalpel-wielding, hands-on abortion training. She bragged not only about her own expertise in procurement of baby body parts, but about the everyday trafficking that goes on “behind closed doors” at countless “affiliates.”

When you’ve recovered from your nausea, ask yourselves this: What kind of country do we live in where law-abiding businesses are fined, threatened and demonized for refusing to bake gay wedding cakes, but barbaric baby butchers are hailed by feminists, Hollywood and a president who asked God to “bless” them?

A reminder about those ‘inspections’ of Iran’s nuclear program Obama has been talking about…

When President Obama announced the nuke deal that Iranian leadership is turning cartwheels over, he was big on pointing out how the U.S. will know that conditions of the agreement have been violated because of the constant inspections:

Because of this deal, we will, for the first time, be in a position to verify all of these commitments. That means this deal is not built on trust; it is built on verification. Inspectors will have 24/7 access to Iran's key nuclear facilities.

Inspectors will have access to Iran's entire nuclear supply chain — its uranium mines and mills, its conversion facility, and its centrifuge manufacturing and storage facilities. This ensures that Iran will not be able to divert materials from known facilities to covert ones. Some of these transparency measures will be in place for 25 years.

Because of this deal, inspectors will also be able to access any suspicious location. Put simply, the organization responsible for the inspections, the IAEA, will have access where necessary, when necessary. That arrangement is permanent. And the IAEA has also reached an agreement with Iran to get access that it needs to complete its investigation into the possible military dimensions of Iran's past nuclear research.

The International Atomic Energy Agency will handle inspections of Iranian facilities, and there will be no American inspectors involved — at all:

Why no American inspectors? It’s part of this great “deal”:

It permits the agency to place more inspectors inside Iran, as long as their native countries have diplomatic relations with Iran — in other words, no Americans

What could possibly go wrong?

Oh well — if the whole deal goes bad, Rice will probably blame a video anyway.


Bonus “nuke deal” points: Not only has the Obama administration agreed wholeheartedly to allow Iran to continue their nuclear programs, but they’ve apparently agreed to help instruct them how to protect their sites from attack — presumably from what Team Obama considers rogue states like Israel:

In what is being viewed as a new development, European countries and potentially the United States agreed to "cooperate with Iran on the implementation of nuclear security guidelines and best practices," according to a copy of the agreement furnished by both the Russians and Iranians.

This will include "training courses and workshops to strengthen Iran's ability to prevent, protect and respond to nuclear security threats to nuclear facilities and systems as well as to enable effective and sustainable nuclear security and physical protection systems," according to the text.

Additional "training and workshops" would work to "strengthen Iran's ability to protect against, and respond to nuclear security threats, including sabotage, as well as to enable effective and sustainable nuclear security and physical protection systems," the text states.

The language was viewed as disturbing by analysts and experts who said such cooperation could help protect Iran against efforts by the Israelis or other countries to sabotage the Islamic Republic's nuclear program in the future.

I’m picturing a Tehran version of the Iron Dome where any incoming threats to Iran’s nuke program would be taken out by a missile defense system mounted on John Kerry’s head:

BREAKING: Four U.S. Marines, Police Officer Shot In Chattanooga, Tennessee Attacks

Like all domestic military facilities, the targeted facilities were “gun free zones.”

Four U.S. Marines and a law enforcement officer have been shot in attacks on two military recruiting centers in Chattanooga, Tennessee. Details are still very preliminary, but this is what we have so far:

NBC’s Pete Williams reports that five people have been shot: one police officer, and four Marines.

The shooting incident began on the U.S. Naval Recruiting on Lee Highway in Chattanooga ended at the U.S. Naval Reserve Center on Amincola Highway Thursday morning about 11am.

A Chattanooga police officer was shot, according to Chattanooga Mayor Andy Berke. Both Berke and CPD Cheif Fred Fletcher visited the shooting scene and went to the hospital to check on the officer.

The Hamilton County Medical Examiner is on standby, but has not been dispatched to either of the scenes.

Blood Assurance has send multiple units of blood to Erlanger; requesting donations to add those who’ve been injured, shot.

The Department of Homeland Security has activated their Chattanooga Strike Team, other district strike teams have been put on standby.

Chattanooga police have stated that the situation is now over, and national news media are claiming that the attacker may be deceased.

We will update this story as we have more verifiable information.

This attack follows a 2009 recruiting office shooting in Little Rock, AR, by a Muslim convert that killed one soldier and wounded another.

Update: Four Marines and the attacker have been officially confirmed killed in the attack in a multi-agency press conference. Three people, including the police officer noted in the original story, were wounded. The police officer was wounded as one of several officers who engaged and killed the shooter.

The U.S. Attorney is investigating the attacks an acts of domestic terrorism until it is proven otherwise. The suspect had multiple weapons, but the FBI is refusing to specify what they are at this time.

Then we vote to single out one particular Weasel for special mention, to whom we award the statuette of shame, our special, 100% plastic Golden Weasel. This week’s nominees were all particularly slimy and despicable, but the votes are in and we have our winner…the envelope please…

Pravda-on-the Hudson And The Compilers Of Its Faux ‘Best Seller ‘ List

JoshuaPundit : Sometimes it’s small, sleazy actions that best bring out the true Weasel behavior.

Ted Cruz has a brand new book out, “A Time For Truth,” published on June 30. Unlike most of these sort of books, it’s an autobiography Ted Cruz wrote himself sans ghostwriter, and it really does give you an understanding of whom he is, what he believes and why. And it’s also a pretty good read.

The book sold 11,854 copies in its first week, according to Nielsen Bookscan’s hardcover sale numbers. That’s more than 18 of the 20 titles that appeared on the New York Time’s bestseller list for the week ending July 4. Aziz Ansari’s “Modern Romance,” which was #2 on the list, sold fewer than 10,000 copies. Ann Coulter’s “Adios America,” at #11, sold just over half as many copies that week.It is currently #4 on the Wall Street Journal hardcover list, #4 on the Publisher’s Weekly hardcover list, #4 on the Bookscan hardcover list, and #1 on the Conservative Book Club list.

Ted Cruz’s book did not appear on the New York Time’s bestseller list at all and still hasn’t even though it’s still selling in the top five.

When Harper Collins inquired why the Times was  the Cruz book, they were told by Times spokesmouth Eileen Murphy that the book “didn’t meet our standards for inclusion.”

“Our goal is that the list reflect authentic best sellers, so we look at and analyze not just numbers, but patterns of sales for every book.” She then accused Harper Collins of arranging bogus bulk sales, claiming that “the overwhelming preponderance of evidence was that sales were limited to strategic bulk purchases,”

No less than Amazon,  the largest Internet retailer in the country outed this for the horse manure it was:

“As of yesterday, ‘A Time for Truth’ was the number 13 best-selling book, and there is no evidence of unusual bulk purchase activity in our sales data,” Sarah Gelman, Amazon’s director of press relations, said in an email.

Amazon’s findings match those of HarperCollins, the book’s publisher, which said Friday that it had “investigated the sales pattern” for Cruz's book and found “no evidence of bulk orders or sales through any retailer or organization.” Moments after that announcement, Cruz’s campaign issued a press release accusing the Times of lying and calling on the paper to provide evidence of bulk purchasing or else formally apologize.

"The Times is presumably embarrassed by having their obvious partisan bias called out. But their response — alleging 'strategic bulk purchases' — is a blatant falsehood," Cruz campaign spokesperson Rick Tyler said in a statement Friday. "The evidence is directly to the contrary. In leveling this false charge, the Times has tried to impugn the integrity of Senator Cruz and of his publisher HarperCollins."

Ironically, according to Keith Urbahn, the book’s literary agent,the Times’ weasel actions are actually helping sales.

You know, my father of blessed memory (Z”l) used to have a very Brooklyn expression I can’t repeat here for people who tried to pull this sort of weasel thing and got caught at it. The very pettiness of the action and the easily debunked blatant lie to try and justify it is reminiscent of Hillary Clinton, and the Times handled it the same way she did – stonewalling it as long as possible and then very quietly, without admitting any wrongdoing or really apologizing just moving on:

Times spokesperson Eileen Murphy said that the newspaper made no changes to its selection process, and so the fact that Cruz's book is being included now suggests a rise in individual purchases, spurred by his public battle with the paper.

"This week's NYT best seller list was arrived at using the same process as last week's – and the week before that," Murphy wrote. "That process involves a careful analysis of data, and is not influenced in any way by the content of a book, or by pressure from publishers or book sellers."

Have you ever heard such horse manure? Now, after lying about ‘bulk strategic purchases’ as an excuse to blackball Cruz’s book and being outed by the publisher and biggest major retailers as the weasels they are, they finally admit Cruz’s book to their putrid list where it debuts at number 7 rather than number 3 where it  would have had they  allowed it on the list when it first came out. And this is the so-called ‘paper of record.’ If they’d lie about something like this, can you imagine what they lie about when they present ‘the news?’

And this Eileen Murphy…her official title at the Times where she’s worked for the last four and a half years is ‘vice president of corporate communications.’  I know, jobs are hard to come by, but imagine you had to wake up in the morning and mouth these sordid prevarications for a living to earn a paycheck. So I decided to award the Weasel to her, so she can share it with her co-workers. It’ll look great right next to the Jayson Blair portrait, Walter Duranty’s Pulitzer Prize, and other mementos of Time’s history to remind them all of whom they really are every time they look at the Golden Weasel.

Well, there it is.

AFFH is easily one of President Obama's most radical initiatives, on a par with Obamacare in its transformative potential. In effect, AFFH gives the federal government a lever to re-engineer nearly every American neighborhood — imposing a preferred racial and ethnic composition, densifying housing, transportation, and business development in suburb and city alike, and weakening or casting aside the authority of local governments over core responsibilities, from zoning to transportation to education. Not only the policy but the political implications are immense — at the presidential, congressional, state, and local levels.

-ITEM #2:

From the New York Post, John Crudele reporting [FYI: he’s been investigating corruption at the Census Bureau for quite some time and has done a bang-up job of it], we learn [tip of the fedora to Instapundit]:

There's something scary in Census Director John Thompson trying to secretly find someone to run the $ 13 billion 2020 decennial census — by using his personal e-mail because he wanted to hide the process.

There is something even more frightening in the blatant politics that were going on behind the scenes.

Candidate Eleven had the job all but sewed up. She was flown to Washington and her expenses were paid by Census, a courtesy that wasn't accorded any of the other candidates. She even dined with senior Census officials.

Next to her name in an internal document the headhunter wrote, "hired. Start 1/1/2014."

Then politics entered the picture.

Candidate Eleven still had to get through someone described as "a senior political appointee at the Department of Commerce." There was no further identification except that the senior appointee was male, which leaves out Commerce Secretary Penny Pritzker.

But suddenly Candidate Eleven's prospects weren't looking very good and, ultimately, she wasn't hired. The job would eventually stay with someone who already worked at Census.

The senior appointee told the Office of Inspector General that he "meet(s) with lots of people that I'm constantly scoping out for possible positions."

The head of the 2020 census, however, isn't just any old position. The census that is conducted every 10 years is mandated by the US Constitution and is used to determine how our population has shifted.

And that determines where federal tax money will be allocated for roads and schools and such. And, most importantly, the 2020 census will determine how many representatives to the House each state will have.

It is so important, in fact, that the Democrats and Republicans fought for control over the 2010 census when President Obama first came to office.

So someone ought to find out what the hell "a senior political appointee at the Commerce Department" was doing getting involved in picking the person who will have so much control over something so politically important.

-That coming Constitutionally-mandated Census will be even more important now that the implementation of the Affirmatively Furthering Fair Housing Rule, it’s prospects for success, will depend on what racial and ethnic numbers appear on it. I suspect that it is the intention of The Jarrett Junto to use the 2020 Federal Census as a hammer to pound the AFFH into shape.

[As for the argument that it is likely The Jarrett Junto will no longer be in power in 2020…

1) there is no assurance that the Left will be not in control of the Executive Branch then – in fact, considering the dreadfully corrupt state of our voting system, it is rather likely they will, but even if they are not, it will not matter because…

2) no matter what Republican is in control of the day-to-day operations of the national government as President, (a) the Administrative State has a life of it’s own, separate from any elected head and (b) it would be a real surprise if any Republican President we have at that time will have the testicular fortitude to repeal the AFFH and depoliticize the Census Bureau.]

Am I crazy?

Violent Drug Abuser Escapes Ambulance, Invades Home, Gets Shot

A Florida drug addict high on the street drug “Molly” forced his way into a home and threatened to kill the home owner early Wednesday morning. The home owner, a retired law enforcement officer, issued a terse, single-note response. Boom.

Officers were called to the 2600 block of Thomasville Road around 12:30 a.m. Wednesday after receiving multiple calls about someone trying to break into homes in the area.

The homeowner, a retired law enforcement officer who did not wish to be identified, told WCTV that he and his wife awoke to a loud crashing sound.

When he opened the bedroom door, 27-year-old Jarod Clemons was in the house and repeatedly saying “I’m going to kill you, I’m going to kill you,” according to the homeowners.

That’s when he fired one shot that hit the Clemons in the chest.

The home shows visible signs of a confrontation, the glass door is completely shattered and there are dirt markings in the doorway. Clemons threw a 50 pound planter trough the glass front door.

Neighbors told WCTV they saw a man jumping fences and going door to door, banging on them and trying to break into homes.

Mr. Clemons had taken the drug earlier in the evening and had a series of psychotic breaks that saw him flee his girlfriend’s car, then go to a police station to try to get help, and them flee the ambulance that the police called after first assaulting an EMT. It was after escaping the ambulance that Clemons started banging on the doors of homes threatening people, before finally breaking into the home of the retired officer and collecting a single well-aimed shot.

It’s sad home many of the defensive gun uses (DGUs) we cover come as a result of drug abuse. We’ve covered several home invasions so far this year where someone attacked residents while high on drugs. The 2013 Gardena police shooting we covered yesterday was the result of a man who was high on meth and alcohol interjecting himself into a police stop of two other men and acting erratically. We’ve covered many defensive gun uses where the criminals were committing crimes so that they could steal money or property to use to finance their next fix.

This abuser crime doesn’t even scratch the surface of the larger issue of the thug culture in this country that is financed primarily through the trafficking of illegal drugs, and which spurs so much of the nation’s gang violence.

Addicts can be very, very dangerous people.

The homeowner in this situation could only take Jarod Clemons at face value when he threw a 50-lbs planter through their front door and stormed into their home, screaming that he was going to kill them.

The retired officer may have taken the shot, but Jared Clemons killed himself.

GREEN BAY — A suspect in a July 4th stabbing was previously removed from the United States for being in the country illegally, according to a federal immigration official.

Victor Paz-Castellanos is charged with attempted first-degree intentional homicide and three other charges for allegedly stabbing his ex-girlfriend during an argument just after the fireworks ended.

When he appeared in court, prosecutors indicated Paz-Castellanos is a citizen of Honduras and is in the United States illegally.

In response to questions from FOX 11, Gail Montenegro, public affairs officer for the regional U.S. Immigration and Customs Enforcement agency, provided this statement:

«U.S. Immigration and Customs Enforcement (ICE) placed a detainer on Victor Manuel Paz-Castellanos July 15 at the Brown County (Wisconsin) Jail following his arrest on local charges. Paz-Castellanos, a citizen of Honduras, was previously removed from the United States Oct. 10, 2014. Following the completion of this case, ICE will request notification to take Paz-Castellanos into custody for removal,» she wrote.

No, Whataburger is not defying Texas open carry laws

Beloved fast food chain of the South, Whataburger, recently found itself in national headlines after announcing their decision not to participate in Texas’ newly minted open carry law.

Full disclosure before we move forward, I love Whataburger. Love. Love. Love. In fact, I had a #1 with cheese, no veggies, and mayo for lunch/dinner today.


But love of hot, crispy fries, and breakfast taquitos at midnight aside, Whataburger is being portrayed inaccurately.

Drawing fire from many, even factions on the right, Whataburger was accused of “taking a stand” against a law near and dear to the hearts of many Texans.

Yahoo News reported:

Whataburger takes stand against Texas’ new open carry law

An iconic Texas restaurant chain will not allow the open carrying of guns on its properties, and industry experts say other restaurants will likely take the same stand against a new state law legalizing the practice in many public places.

Whataburger — with some 780 locations in 10 states — has drawn a mix of praise and rebuke since making the announcement this month, including a prediction of boycotts from one of the state’s leading advocates for gun rights.

Boycott? Porquoi?

Preston Atkinson, Whataburger’s President and CEO wrote an open letter addressing the issue. Atkinson wrote:

There's been a lot of talk the past couple weeks about Whataburger's open carry policy, and I wanted to reach out to personally explain our position.

Whataburger supports customers' Second Amendment rights and we respect your group's position, but we haven't allowed the open carry of firearms in our restaurants for a long time (although we have not prohibited licensed conceal carry). It's a business decision we made a long time ago and have stood by, and I think it's important you know why.

But first, as a representative of Whataburger, I want you to know we proudly serve the gun rights community. I personally enjoy hunting and also have my concealed carry license, as do others at Whataburger.

From a business standpoint, though, we have to think about how open carry impacts our 34,000+ employees and millions of customers. We serve customers from all walks of life at more than 780 locations, 24 hours a day, in 10 states and we're known for a family friendly atmosphere that customers have come to expect from us. We're the gathering spot for Little League teams, church groups and high school kids after football games.

We've had many customers and employees tell us they're uncomfortable being around someone with a visible firearm who is not a member of law enforcement, and as a business, we have to listen and value that feedback in the same way we value yours. We have a responsibility to make sure everyone who walks into our restaurants feels comfortable. For that reason, we don't restrict licensed concealed carry but do ask customers not to open carry in our restaurants.

As a company serving customers with many different viewpoints, we're sometimes caught in the middle on controversial issues like this one. We hope you and your members, along with our other friends in the gun rights community, understand our position and will continue to visit us. We appreciate your business. Thank you.

As a gun enthusiast and second amendment-lover, this position strikes me as perfectly reasonable. Particularly when the bill enacted in Texas enables private businesses to prohibit open carry at their discretion.

Section 44 reads:

Chapter 30, Penal Code, is amended by adding Section 30.07 to read as follows:
(a) A license holder commits an offense if the license holder:
(1) openly carries a handgun under the authority of Subchapter H, Chapter 411, Government Code, on property of another without effective consent; and
(2) received notice that:
(A) entry on the property by a license holder openly carrying a handgun was forbidden; or
(B) remaining on the property while openly carrying a handgun was forbidden and failed to depart.
(b) For purposes of this section, a person receives notice if the owner of the property or someone with apparent authority to act for the owner provides notice to the person by oral or written communication.
(c) In this section:
(1) “Entry” has the meaning assigned by Section 30.05(b).
(2) “License holder” has the meaning assigned by Section 46.035(f).
(3) “Written communication” means:
(A) a card or other document on which is written language identical to the following: “Pursuant to Section 30.07, Penal Code (trespass by license holder with an openly carried handgun), a person licensed under Subchapter H, Chapter 411, Government Code (handgun licensing law), may not enter this property with a handgun that is carried openly”; or
(B) a sign posted on the property that:
(i) includes the language described by Paragraph (A) in both English and Spanish;
(ii) appears in contrasting colors with block letters at least one inch in height; and
(iii) is displayed in a conspicuous manner clearly visible to the public at each entrance to the property.

As a private business perfectly within their rights to do so, Whataburger decided it most advantageous to continue to allow concealed carry, but not open carry. Doing so is perfectly within the realm of Texas’ new law and is not “bucking” “standing against” “denying” or any other negative descriptor.

If there must be a conversation over Whataburger’s choice then by all means, fire away. But let’s ensure the law at the center of the debate is understood.

It was code-named The House Of Special Purpose by the Bolsheviks.  Lenin ordered that Nicholas II, ex-Tsar of all the Russias, and his family be imprisoned there, but that was not the 'special' purpose.  This is the Tsar and his family:

On the night/morning of 16/17 July 1918, the family was awakened, told to dress quickly as they would have to leave in a hurry, ushered into a basement room, and were murdered by a bunch of local Bolsheviks.  From Wikipedia:

Around midnight Yakov Yurovsky, the superintendent of The House of Special Purpose, ordered the Romanovs' physician, Dr. Eugene Botkin, to awaken the sleeping family and ask them to put on their clothes. The Romanovs were then ordered into a 6×5 meter semi-basement room. Nicholas asked if he could bring two chairs for himself and his wife. A firing squad appeared next and Yurovsky announced:

" Nikolai Aleksandrovich, your relatives have tried to save you, but they had not to. And we are forced to shoot you by ourselves… "

Yurovsky then began to read the decision of the Ural Executive Committee (Uralispolkom), and Nicholas said "What?" As the weapons were raised, the Empress and the Grand Duchess Olga, according to a guard's reminiscence, had tried to cross themselves, but failed amid the shooting. Yurovsky reportedly raised his gun at Nicholas and fired; Nicholas fell dead instantly. The other executioners then began shooting until all the intended victims had fallen. Several more shots were fired at the victims and the doors opened to scatter the smoke. Some survived the gunshots, so executioner P.Z. Yermakov stabbed them with bayonets because the shouts could be heard outside. The last ones to die were Anastasia, Tatiana, Olga, and Maria, who were wearing several pounds (over 1.3 kilograms) of diamonds within their clothing, thus rendering them bullet-proof to an extent. However they were speared with bayonets as well. Olga sustained a gun shot wound to the head while Anastasia and Maria were said to have crouched up against a wall covering their heads in terror until Maria was shot down, and Anastasia had been finished off with the bayonets. Yurovsky himself killed Tatiana and Alexei. Tatiana died from a single bullet through the back of her head. Alexei received two bullets to the head, right behind the ear. Anna Demidova, Alexandra's maid, survived the initial onslaught but was quickly murdered against the back wall of the basement, stabbed to death while trying to defend herself with a small pillow she had carried into the sub-basement that was filled with precious gems and jewels. Military commissar Peter Ermakov, in a drunken haze, stabbed at the dead bodies of the former Czar and Czarina, shattering both their rib cages in a pool of blood.

The bodies were then loaded into trucks, taken into the woods, desecrated, and buried.

This brutal murder of a whole family was certainly not the first, nor would it be the last, such action perpetrated by Leftists in their various 'glorious' marches to bring about Heaven on Earth [hundreds of millions of souls cry-out to us], but in it, in this one action, is to be found the ultimate representation of where Leftism will always lead: to the slaughter of innocent human beings in the name of ideas — ideology.  Logic dictates that there can be no other end.

As long as Leftism is allowed to thrive, to just exist, then the Olga's, Maria's, Tatiana's, Anastasia's, and Alexis's of this world are not safe from the barrels of Bolshevik guns.  If the Leftists were to control the world, they would turn the whole of it into a House Of Special Purpose.

SIDENOTE: The whole family have been declared Saints by the Russian Orthodox Church…they are certainly Martyrs of Freedom…

Requiescat in pace


In view of the tens of thousands of lives which the Cheka would claim in the years that followed the Ekaterinburg tragedy, and the millions killed by its successors, the death at its hands of eleven prisoners hardly qualifies as an event of extraordinary magnitude. And yet, there is a deep symbolic meaning to the massacre of the ex-Tsar, his family, and staff. Just as liberty has its great historic days —the battles of Lexington and Concord, the storming of the Bastille—so does totalitarianism. The manner in which the massacre was prepared and carried out, at first denied and then justified, has something uniquely odious about it, something that radically distinguishes it from previous acts of regicide and brands it as a prelude to twentieth-century mass murder.

When a government arrogates to itself the power to kill people, not because of what they had done or even might do, but because their death is "needed," we are entering an entirely new moral realm. Here lies the symbolic significance of the events that occurred in Ekaterinburg in the night of July 16–17. The massacre, by secret order of the government, of a family that for all its Imperial background was remarkably commonplace, guilty of nothing, desiring only to be allowed to live in peace, carried mankind for the first time across the threshold of deliberate genocide. The same reasoning that had led the Bolsheviks to condemn them to death would later be applied in Russia and elsewhere to millions of nameless beings who happened to stand in the way of one or another design for a new world order.
